Copyright Policy

Superfan respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which may be found on the U.S. Copyright Office website at copyright.gov, we will respond expeditiously to claims of copyright infringement committed using the Superfan service ("Service") that are reported to our designated copyright agent, identified below.

Superfan is a product provided to you by Sparky Tech, Inc. This Copyright Policy is part of, and incorporated into, our Terms of Use.

Reporting Copyright Infringement

If you are a copyright owner, or authorized to act on behalf of one, and you believe that content on Superfan infringes your copyright, you may submit a takedown notice to our designated copyright agent. Your notice must include substantially the following:

Identification of the copyrighted work you claim has been infringed, or, if multiple works are covered by a single notice, a representative list of those works.
Identification of the material you claim is infringing and that you want removed or disabled, with information reasonably sufficient for us to locate it (for example, a link to the post, profile, or other content on Superfan).
Your contact information, including your name, mailing address, telephone number, and email address.
A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
Your physical or electronic signature.

Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing material and make a good-faith effort to notify the user who posted it.

Designated Copyright Agent

DMCA takedown notices and counter-notices should be sent to our designated copyright agent:

Counter-Notices

If material you posted was removed or disabled as a result of a takedown notice and you believe the removal was the result of a mistake or misidentification, you may submit a counter-notice to our designated copyright agent. Your counter-notice must include substantially the following:

Identification of the material that was removed or disabled and the location where it appeared before it was removed or disabled.
A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you reside outside the United States, any judicial district in which Sparky Tech, Inc. may be found), and that you will accept service of process from the person who filed the original takedown notice or their agent.
Your physical or electronic signature.

If we receive a valid counter-notice, we will forward it to the person who submitted the original takedown notice. If that person does not notify us within 10 business days that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed material in accordance with the DMCA.

Misrepresentations

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Do not submit false claims.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, we will, in appropriate circumstances, terminate the accounts of users who are determined to be repeat infringers. We may also, at our sole discretion, limit access to the Service or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.
